Logo registration is a crucial step in protecting a brand’s identity and ensuring exclusive rights over its visual representation. In India, this process is governed by the Trade Marks Act, 1999, and is administered by the Controller General of Patents, Designs and Trade Marks through the Trademark Registry. A logo, being a graphical symbol or design that represents a business, product, or service, can be registered as a trademark to prevent unauthorized use and build legal ownership.

The first step in logo registration is creating a unique and distinctive logo. It should not resemble any existing registered trademark and must be capable of distinguishing your goods or services from others. Once the logo is finalized, a trademark search is conducted using the IP India portal to ensure that no similar mark exists. 

After confirming the logo’s uniqueness, the applicant must identify the appropriate trademark class. India follows the NICE Classification system, which includes 45 classes—Classes 1 to 34 for goods and Classes 35 to 45 for services. Each class requires a separate application and fee, so selecting the correct class is essential for proper protection.

Once filed, the applicant receives an acknowledgment and can begin using the ™ symbol with the logo.
